NEW DELHI, AUGUST 19—The Allahabad High Court on Tueday deferred the verdict in Dr. Kafeel Khan case till August 24 as certain documents could not be presented before the court due to poor mail and courier services owing to lockdown.

Dr. Kafeel Khan was arrested from Mumbai on January 30 where he had gone to address an anti-Citizenship (Amendement) Act (CAA) rally.

His arrest was made by a joint team of UP and Mumbai police soon after he landed at the Sahar Airport in connection with an FIR registered against him in Aligarh for making allegedly “inflammatory remarks” at an anti-CAA rally at the main gate of the Aligarh Muslim University on December 13. He was booked under Section 153-A (promoting enmity between different groups on ground of religion. Later on, he was booked under National Security Act.

Speaking to India Tomorrow, Dr. Khan’s brother Adeel Khan said that his mother Nuzhat Parween had moved the Supreme Court on February 28 and the apex court on March 18 directed the Allahabad High Court to hear the case. However, hearing in the case could not be held due to lockdown and Covid-19.

“When we did not get relief for five months, we moved the apex court again on July 30. The apex court on August 11 ordered the high court to decide the matter within 15 days. The SC, in its order, observed that the top court respects the individual freedom of every citizens”, said Adeel Khan.

Expecting that the high court would order release of Dr. Kafeel Khan on August 24, Adeel Khan wondered why National Security Act (NSA) was applied against his brother because he had not done anything that invited NSA.

He said that NSA was applied against over 1 lakh people in UP but Dr. Kafeel Khan’s case is rare because Dr.Kafeel’s detention under NSA was extended thrice.
