Civil suit filed for removal of Shahi Idgah in Mathura

NEW DELHI—A civil suit has been filed in the name of Hindu deity, Bhagwan Sri Krishna Virajman, in a local court in Mathura, seeking ownership over entire 13.37 acres of land by removing Shahi Idgah Masjid that is built over it.

The suit claims that the land is Krishna Janmabhoomii and be given back to the deity. The suit was filed on September 25.

The plea has been filed through the ‘next friend’ of the deity, Ranjana Agnihotri. There are also six other petitions who call themselves as devotees of Lord Shrikrishna. They have claimed the plaintiff as Bhagwan ShriKrishna Virjman at Katra Keshav Dev Khewat, Mauja Mathura Bazaar City.”

The advocates in the case are Hari Shankar Jain and Vishnu Jain.

The suit has made UP Sunni Central Waqf Board, Committee of Management Trust of Shahi Masjid Idgah, as the respondents.

The civil suit seeks “removal of encroachment and superstructure illegally raised by Committee of Management of Alleged Trust Masjid Idgah with the consent of Sunni Central Board of Waqf land Khewat No.255 (Two Hundred Fifty Five) at Katra Keshav Dev city Mathura belonging to deity Shree Krishna Virajman.”

Describing the first petitioner, the deity itself, the petition states that the deity is recognized under Hindu Law.

“He is minor. He is a juristic person. He can sue and be sued through shebait and in his absence through next friend. It can own, acquire and possess the property. It has every right to protect its property and to recover its lost property through shebait and in absence of shebait through next friend by availing an appropriate remedy in Court of law”, the suit says.

The second petitioner is the Shri Krishna Janmabhoomi which, according to petition, enjoys “special significance under the Hindu law”. Other petitioners are devotees of the deity.

The suit alleges that Committee of Management of Trust Masjid Idgah is without any authority of law and has encroached upon the land belonging to the deity, through a compromise with the Society Shree Krishna Hanmasthan Seva Sangh on October 12, 1968.

The petitions states that a part of the temple standing at the birth place of Lord Shree Krishna at Katra Keshav Dev was demolished in 1669-70 during the reign of Aurangzeb and Shahi Idgah was constructed over it by using the might of the state.

The suit demands that the compromise deed of 1968 between “Shree Krishna Janmasthan Seva Sangh” and the Shahi Idgah Trust be quashed. It wants that Shahi Idgah be removed and the land over which it stands be handed over to the deity which is Shrikrishna Janmabhoomi. It says that entire land of 13.37 acres of Katra Keshav Dev vests in the deity Bhagwan Shree Krishna Virajman and U.P.Sunni Waqf Board, Trust Masjid Idgah or any member of Muslim community have no interest or right in the property of Katra Keshav Dev.
