Homosexuality: Will move apex court for review, says petitioner

New Delhi, 11 Dec 2013: As the Supreme Court of India on Wednesday quashed a Delhi High Court ruling which had decriminalized gay sex, the respondent, Naz Foundation, termed it as horrible decision and said they will move the apex court seeking review of its judgment.

“It is horrible judgment, it is a black day for the country and we will approach the apex court within a month for review this judgment,” Anjali Gopalan, founder and executive director of the Naz Foundation, told India Tomorrow.

A bench comprising Justice G S Singhvi and Justice Sudhansu Jyoti Mukhopadhaya on Wednesday quashed the Delhi High Court judgment of 2009 which had ruled that section 377 of the Indian Penal Code prohibiting “carnal intercourse against the order of nature” infringed the fundamental rights of Indians.

Setting aside the High Court verdict, the apex court said there was no constitutional room for change in Section 377 of the Indian Penal Code, which holds same-gender sexual relationship as an act against the order of the nature and as an offence.
