NIA absolves ex-militant Liyakat Shah of terror charges

New Delhi, 24 Jan 2015: The National Investigation Agency on Saturday filed a charge-sheet in the March 2013 terror conspiracy case of Delhi and absolved Jammu and Kashmir resident Syed Liakat Shah of all terror charges. The Special Cell of Delhi Police had arrested him on 20th March in 2013 claiming he was coming to Delhi through Nepal to carry out terror attacks.

NIA has today filed charge-sheet in RC 03/13/NIA/DLI (Sayyed Liyakat Shah Case), before the NIA Special Court, Patiala House, New Delhi.

In a press statement, the NIA said: “The investigation conducted by NIA has revealed that the charges against the accused were not proved and that he was coming into India to obtain the benefit of the surrender policy of the Government of Jammu and Kashmir.”

Soon after his arrest in March 2013, the Delhi police had recovered some explosives from a guesthouse in Old Delhi, which, it said, were for Shah to carry out the terror attacks in Delhi.

However, the NIA has in its investigation found that the explosives were planted.

“Further, NIA investigation has revealed that Sabir Khan Patna s/o Fida Mohammad c/o Barrack No. 2, Special Cell Niwas, BG 21, Lodhi Colony, New Delhi and permanent resident of village Gelana, Tehsil Susner, District Shahjahpur, Madhya Pradesh, was responsible for the placement of weapons and explosives in the guest house room.”

Accordingly, NIA has filed a charge-sheet against Sabir Khan Pathan, under sections 25 (1-A),25 (1-B) or Arms Act, S.5 of the Explosive Substances Act, and under Sections, 465, 471, 174-A of IPC.

“Further investigation is being conducted to unravel the conspiracy behind the placement of weapons,” said NIA.

Two months after his arrest, the court had granted him bail in May 2013.

Jammu & Kashmir Police had protested the arrest, saying Shah was returning home as per the state government’s policy of allowing people, who had ex-filtrated to PoK in early 1990s, to come back. Then chief minister Omar Abdullah had also raised the issue with the Union Home Ministry.

He has welcomed his acquittal.
“At least I am happy that truth has finally come out and I hope that security agencies do not target Kashmiris to achieve their ulterior motives,” Times of India has quoted him as saying.
