Trial court refuses to issue fresh death warrant in Nirbhaya case

NEW DELHI, FEBRUARY 7—Delhi’s Patiala House Court after the conclusion of the arguments has decided to dismiss the state (prosecution) plea seeking issuance of fresh date of execution. The court has held the application to be premature and has granted leave to the state to prefer the same at an appropriate stage.”The plea is bereft of merits, death warrant can’t be issued on the surmises of conjectures”, ASJ Dharmender Rana of Patiala House Courts said.

The trial court while dismissing the plea of prosecution stated that death warrants cannot be issued on the basis of conjecture alone. “It is criminally sinful to execute the convicts when the law permits them to live,” the court said as reported by live law.

The Court noted that the time period of 7 days granted by the Delhi High Court for the convicts to exhaust their legal remedies was not yet over. Since the convicts have time till February 11 for that, the plea is premature, the judge observed.
