Chandrashekhar Azad Files Review Petition Against SC verdict on Reservation

NEW DELHI, FEBRUARY 11 – Bhim Army chief Chandrashekhar Azad has filed a review petition at the Supreme Court of India on Tuesday against its verdict which said that the states are not bound to provide reservation in appointments and quota is not a fundamental right, reports Live Law. The plea stated that the verdict has diluted constitutional provision.

The review petition stated that the impugned judgment will act as a “tool in the hands of the oppressors to further oppress and exploit the SC, ST, OBC and the economically weaker sections, causing further marginalisation within the society thereby defeating the endeavour to bring equality between the citizens of this country by the framers of our constitution particularly those of Baba Sahab Bhim Rao Ambedkar.”

Azad, who was not a party in the original case in which the judgment was rendered, states in the petition that he has been acclaimed and accepted as the leader of Scheduled Caste and Scheduled Tribe communities all over the country owing to his involvement in several movements for safeguarding their rights.

In a landmark judgment on February 7, the Supreme Court ruled that reservation in promotions for government jobs is not a fundamental right. The top court also said the states cannot be directed to provide promotions to the members of the SC/ST community. Meanwhile, urging the central government to intervene in the Supreme Court’s judgement, LJP President and MP Chirag Paswan said, “Lok Jan Shakti Party does not agree with the Supreme Court’s decision that reservations for jobs, promotions, is not a fundamental right. We urge the Centre to intervene in this matter.”
